A couple in Tennessee recently came home to a backhoe digging a trench across their driveway.  This couple had been using this access easement for 30 years.  However, their new neighbor didn’t agree with the prior arrangement.  

So, the neighbor took the matter in his own hands.  Now they can’t drive up to their home and will have to contact a lawyer to straighten this out.  

With real estate costs on the rise, people are trying to maximize the use of the properties.  And they do not always care about encroaching on the rights of their neighbors.  The law isn’t always clear in these situations and municipalities are being pressured into additional enforcement. 

While it always hasn’t been this way, land use rights have recently become a hot topic in fast-growing cities.  Things that were commonplace 10 years ago are no longer the norm today.
